This Website is operated by SynIQ Sports Inc (“we”, “us” and/or “our”). At SynIQ Sports, we take protecting your privacy seriously. In order for you to utilize or inquire about our services, we need to collect and use some of your personal information. We want you to understand what personal information we collect and how it is used.

Personal information we collect

If you contact SynIQ Sports in order to inquire about or otherwise make use of our services, we may collect personal information such as:

Payment information if you purchase our products or services; and
Any additional information about you or your company that you provide when you communicate with us.

Log information

SynIQ Sports automatically gathers and stores certain information in our server logs about the use of SynIQ Sports's services, including the number of unique visitors, the frequency of visits, how users interact with our services, user experience preferences, and other information that may help SynIQ Sports improve the user experience, mitigate fraudulent activity, and comply with legal requirements. Such information may include personal information such as: IP address, Unique Device Identifier, CallerID / ANI (Automatic Number Identification) information, content of web pages, transaction with APIs (Application Program Interface), transactions with IVR (Interactive Voice Response) systems, activity and content of visitor interaction with call center representatives; hardware information, hardware and system settings, browser type, browser language, the date and time of your request, or referral URL.

Tracking technologies

SynIQ Sports and its partners use cookies or similar technologies on our websites to analyze trends, administer the site, track users' movements around the site, tailor and deliver advertising that may be more relevant or interesting to our users, and gather demographic information about our user base as a whole.

A cookie is a small data file that is managed by your web browser or other application and stored on your local system. SynIQ Sports uses session and persistent cookies to, among other things, identify your device during a particular interaction, analyze your behavior during a particular visit, and serve you advertising.

Do Not Track

Do-Not-Track is a public-private initiative, http://www.w3.org/2011/tracking-protection/, that has developed a technical “flag” or signal that an end-user may be able to activate within their browser software to notify sites that they do not wish to be “tracked” by third parties as defined by the initiative. The initiative, however, has not reached a consensus as to exactly what technical or other actions those parties receiving the signal should take. As a result, Do-Not-Track has not yet been standardized and most sites, including SynIQ Sports sites, do not alter their behavior or change their services when they receive a “do-not-track” flag or signal. You can, however, make decisions about your privacy and the advertisements you receive.

Third-party data sources

SynIQ Sports may leverage external data sources in order to provide context and background on the users of its services in order to improve customer experience, mitigate fraud or malicious activity, or comply with internal company and external regulatory requirements.

How we use your personal information

For individuals sharing personal information with SynIQ Sports in order to inquire about or otherwise make use of our services, we will use your personal information in order to provide the requested information, products, and/or services. Such uses may include:

Improving the quality of our services;

Enabling our business partners and service providers to perform certain activities on our behalf;

How we share your personal information

We will not use or disclose your personal information to non-affiliated third parties except as disclosed in this policy.

SynIQ Sports may transfer your personal information to:

Non-affiliated companies to assist us in providing, maintaining and operating our services or marketing. These companies are required to comply with the principles set out in this Policy and only use such information for the purposes for which it was provided to them; and
A third-party, in the event of a proposed or actual purchase, sale (including a liquidation, realization, foreclosure or repossession), lease, merger, amalgamation or any other type of acquisition, disposal, transfer, conveyance or financing of all or any portion of its business or of any assets or shares of our business or a division thereof. SynIQ Sports may also disclose your personal information to:

Defend our rights and/or property or the rights and property of others;
Enforce our Terms of Use and/or this policy;

How we protect your personal information

We use commercially reasonable technical, administrative, and physical controls best practices to protect your personal information including data encryption where appropriate; however, since the internet is not a 100% secure environment, we cannot ensure the security of personal information during its transmission between you and us. Accordingly, you acknowledge that when you transmit such personal information, you do so at your own risk. We will notify you of any confirmed security breach of your personal information to the extent required by and in accordance with applicable law.

How long we keep your personal information

SynIQ Sports will retain your personal information as long as necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required or not prohibited by applicable law.

Your rights related to your personal information

While we take various steps to ensure the accuracy and completeness of your personal information, we rely upon you to provide accurate and complete personal information when interacting with us.

Upon your request and as allowed or required by law and consistent with our policies, you may request SynIQ Sports to take the following actions with your personal information: (i) provide you with a copy, (ii) correct, (iii) update, or (iv) delete. For End Users of a Subscribing Entity that Uses SynIQ Sports Services

Your academic Subscribing Entity, organization or company (collectively, the Subscribing Entity) decides how your personal information is used. We provide most of our products and services to end-users of a Subscribing Entity as a so-called 'data processor' on behalf of our clients (for example, school, districts, universities, and corporations). This means that the main responsibility for data privacy compliance lies with your Subscribing Entity as the 'data controller.'' It also means that your Subscribing Entity's privacy statement applies to the use of your personal information (instead of ours). Your Subscribing Entity determines what information we collect through our products and services and how it is used, and we process your information according to your Subscribing Entity's instructions and the terms of our contracts with your Subscribing Entity.

Read your Subscribing Entity's privacy statement. The following section is for informational purposes and describes how your information is generally used when we provide products and services to you on behalf of a client. How your information is used depends on your Subscribing Entity, so you should read your Subscribing Entity's privacy statement.

Information We Collect

Information your Subscribing Entity provides to us. Typically, our products and services integrate with your Subscribing Entity's systems. As such, your Subscribing Entity will provide us with information about you to set up and maintain your account or for us to be able to provide the product or service. This includes information in the following data categories:

Account information: The exact data elements will depend on the product, but often we receive your name, email address, student ID, account credentials, and courses you are enrolled in when we initially set up the products and services for your Subscribing Entity. We will receive regular updated information to keep your account information accurate and up to date.

Directly from you. Depending on the products and services you use, we will collect the following data categories directly from you:

Profile information: We collect your first and last name, email address, and similar contact data when you provide or update this information in our products.
Credentials: Our products and services often integrate with your Subscribing Entity’s systems and rely on the credentials your Subscribing Entity uses. Where this is not the case, we will collect passwords, password hints, and similar security information that we use for authentication and account access.
Content and activity: We collect data about your interactions with our products and services (including but not limited to written transcripts and voice recordings of your conversations and interactions with the AI avatars).
Audio and video recordings. Some of our products allow you (as a student or instructor) to submit audio and video feedback, and we collect the related information, including metadata.
Support. When you or your Subscribing Entity contacts us for support, we may collect limited information about you that you or a representative of your Subscribing Entity provides to us. We use this information only to assist with client support cases on behalf of your Subscribing Entity. When you contact us, your phone conversations or chat sessions with our client support teams may be monitored and recorded for training and quality purposes. Some of our products and services also have feedback functionality that collects limited information about your device, the product, and your Subscribing Entity such as your user ID or school ID when you provide feedback.

Indirectly from you. We collect information on how you use our products and services. Depending on which product or service you use, this may include the following data categories:

Chat and audio recordings. Some of our products allow for sessions to be recorded.
Device and usage. We collect device and usage information when you access and use our products and services, including information that your browser or the mobile app sends when you are using it. This data may include your unique device identifier, Internet Protocol address, your browser type and configuration, the date and time of your use of the product or service, language preferences, and cookie data.

How We Use this Information

On behalf of your Subscribing Entity. We use your information on behalf of and under the instruction of your Subscribing Entity, which is the data controller. We use the information in accordance with our agreement with your Subscribing Entity to operate, maintain, and provide the features and functionality of the products and services. Your Subscribing Entity determines how your information is used.

Analytics and Recommendations. Providing our products and services to your Subscribing Entity may include analytics functionalities. Among other things, such functionalities can indicate your performance compared to that of your peers, project your future performance, and provide this information to instructors and other staff of your Subscribing Entity. Some of our products and services will also provide recommendations or suggest actions to your instructors / staff or directly to you based on the available data, so that your Subscribing Entity can support you.

Product enhancement and research. Where the agreement with your Subscribing Entity gives us the permission, we may also use:

Your personal information to evaluate and improve our products and services and develop new products and services
De-identified information for other purposes such as carrying out research and analyzing trends

When we use information for these purposes, we will implement appropriate safeguards. This may include removing or hashing direct identifiers (e.g., your name, email address, and device ID) from the data set before carrying out research and analysis.

Who We Share this Information With

We share your information in accordance with our agreement with your Subscribing Entity. Generally, this includes the sharing of data within and outside of SynIQ Sports.

Within SynIQ Sports. Your information will be accessed only by those who have a need to know to provide the products and services to your Subscribing Entity and improve them. For instance, our technical teams and client support teams may have access to your information when we set up the product for your Subscribing Entity or when software or database changes are required for support and maintenance purposes.
With your Subscribing Entity. Much of the personal information we collect and use about you is shared with your Subscribing Entity that uses our products and services and with other Subscribing Entity users. What information is shared depends on the product functionality, settings, and instructions of your Subscribing Entity. Please read your Subscribing Entity’s privacy statement to learn more.
Outside SynIQ Sports. We use vendors to help us provide our products and services to you on behalf of your Subscribing Entity. Our products and services may also integrate with third party products of your Subscribing Entity and exchange personal information to enable a seamless and secure integration. Where we use third-party tools (for example to understand how our products and services are used), these third parties will have access to some of your personal information.

Your Subscribing Entity may ask us to share such information with additional parties or it may share your information further. Please read your Subscribing Entity's privacy statement.

For non-U.S. residents

We may transfer personal information that we collect about you outside of the country in which it was collected. If you are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring personal information about yourself to a country and jurisdiction that does not have the same data protection laws as the European Union or other region. By doing so, you are consenting to the transfer, use, and disclosure of personal information about yourself to the U.S. as described in this policy.

A few notes about social media

Please be aware that any information that you submit to a social media site such as Facebook, Instagram or Twitter is done at your own risk and without any expectation of privacy. SynIQ Sports cannot control the actions of social media site users and is not responsible for any content or submissions contained on such sites. You should always review the privacy policy of any third-party website, product, service, or application.

By using any functionality that permits submissions to social media sites, you are indicating that you have reviewed the applicable privacy policy and terms of use of that site. Additionally, in the event that we offer functionality through our services that permits the posting of content on social media, please be aware that these sites may allow you to publicly post and share this content. SynIQ Sports cannot guarantee the privacy and safety of these sites and is therefore not responsible for any content you post. Use these features at your own risk.

Children under 13

Our services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you become aware that your child is accessing the services and providing personal information without your consent, please contact us by using the information provided below. We will take steps to remove personal information from our storage systems and terminate the account (where applicable) if we determine that a child under 13 has accessed the services.

How you are notified if the policy changes

We may change this policy from time to time. If we do, we will post the updated policy with the last revised date. Your continued participation in the SynIQ Sports websites and/or our services means that you consent to the updates. You should periodically read the policy to understand our privacy practices.

If we make material changes to this Policy, we will notify you in the site, product, service, or application or by email and seek your affirmative consent where required.

Communicating with you electronically

By participating in the SynIQ Sports websites and/or our services, you agree that we can communicate with you electronically. This includes any required notifications (i.e. legal, technical, regulatory, security, privacy).

Commercial messages

Your California privacy rights

California Shine the Light Law

California residents may opt-out of SynIQ Sports disclosing their personal information to third parties for their marketing purposes. If you are a California resident and do not want SynIQ Sports to disclose your information to third parties for their marketing purposes, please contact SynIQ Sports by any of the ways described in the Where to turn with questions section below and SynIQ Sports will respond within 30 days.

California Consumer Privacy Act (CCPA)

The CCPA provides privacy protections for California consumers through the provision of certain disclosures and granting of specific rights. If you are a California consumer, the following sections provide you with these disclosures and information about your rights and how to exercise them, should you choose to do so.

Sale of your Personal Information

We do not sell any Personal Information as the term is traditionally understood. However, under the CCPA, in the preceding 12 months certain methods of advertising we have used could be considered a sale of personal information to third parties that assist us in providing, maintaining and operating our marketing. This personal information includes the following categories:

Identifiers;
Internet or other similar network activity; and
Inferences from personal information.

We use this personal information to tailor and deliver advertising that may be more relevant or interesting to you, including serving targeted ads.

You may opt out of the sale of your personal information by contacting us by telephone or mail as provided in the Where to turn with questions section below.

In addition, if you visit our website, we engage in selling that may not identify you specifically, but rather the device or browser you use. You may opt out of this type of selling by toggling off certain cookies or other similar technologies. This is done by blocking and deleting cookies or similar technologies in your browser. We do not sell the personal information of individuals under the age of 16 if we have actual knowledge of the individuals' age.

Access to and deletion of your Personal Information

Information Request: By submitting an information request, you may ask that SynIQ Sports provide you with a copy of your Personal Information.
Deletion Request: By submitting a deletion request, you may ask that SynIQ Sports delete any of your Personal Information that we have collected about you and retained, subject to certain exceptions. These exceptions include but are not limited to the following:

Providing a good or service that you requested, taking actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise performing our contract with you;
Detecting security incidents and protecting against fraud or illegal activity;
Debugging products and services;
Enabling solely internal uses that are reasonably aligned with consumer expectations;
Complying with a legal obligation; and
Making other internal and lawful uses of your Personal Information that are compatible with the context for which you provided it.

SynIQ Sports has implemented various measures to monitor compliance with and enforce this Policy.

Exclusions

This Policy shall not apply to any unsolicited information you provide to SynIQ Sports through our website, our services, or through any other means. This includes, but is not limited to, information posted to any public areas of our website or our services, such as forums, any ideas for new products or services, or modifications to existing products or services, and other unsolicited submissions (collectively, “Unsolicited Information”). All Unsolicited Information shall be deemed to be non-confidential and SynIQ Sports shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.
